    I really wish I had read reviews on this firm before hiring them. I hired Kelly R. McCarty in their Austin office and also experienced a level of rudeness, mentioned by other reviewers, on my first phone call. I came in for a consultation for some direction in my divorce / custody case. I was not ready to hire legal representation. It was my first marriage and divorce. A couple months passed and my divorce abruptly took a turn for the worse. I hired Kelly R. McCarty because he was the first and only lawyer I'd spoken to about my case. Kelly was unfriendly and generally short with me, but I wasn't hiring a friend and didn't take it too personally. He was confident about my case and we had our temporary orders hearing. It turned out horribly! Just the opposite of what we were expecting. Kelly did not object during the hearing to some very obvious damaging hearsay information that was disclosed by the other party. Also, even though we had brought my financial info to the hearing, somehow it was missed and not entered into evidence! So no temporary child or spousal support was granted. My husband made nearly 15 times my income and I wasn't going to get any temporary financial support! My daughter was also ordered to be in daycare 5 days a week and on a 2-2-3(50%) visitation schedule. I had been her primary caretaker since birth and she'd never been in daycare. She was only about 6 months at the time. Not even crawling at this point! This disaster hearing set the stage for more obstacles to come. As the new hearing approached, Kelly was pressuring me to make a deal of 50/50 visitation that I did not want! My biggest concern was that my daughter was stuck in daycare and the current 50/50 visitation order that I did not want. Kelly did not listen to my concerns. Initially, he suggested the new hearing, but now that my husband and his lawyer were offering a measly amount of child support, Kelly completely changed his tune and pressured me to make a deal I did not want in lieu of the new hearing! The day of the De Nova hearing came and there was still no agreement in place. Kelly negotiated a deal with the other lawyer without providing me some very specific details. I never would have agreed to the deal had those details been provided to me. My husband is very manipulating and certainly would have used the undisclosed stipulations to his advantage. Kelly knew my case and knew these details would be important to me. However, he did not discuss them with me! The new temporary orders draft was written up by the opposing attorney. I read it and saw the inconsistencies for the first time. I IMMEDIATELY contacted Mr. McCarty. He did not respond to me about my particular concerns for days and not until after an incident had arose between my husband and I. He told me he would contact me the next morning to discuss the details. In the new temporary orders agreement, Kelly would receive $2500 on my husband's credit card, in which there would be a lean put on my business inventory. I agreed to the new orders agreement largely on the fact my daughter would only be in daycare 2 days instead of 5, and Kelly told me the $2500 he'd be receiving would provide me his legal representation for about the next 6 weeks until the final divorce trial. The morning Kelly finally contacted me in response to the inconsistencies in the new agreement, he first sent me an invoice(for the very first time in months) for $10,000. The balance reflected the $5000 he'd already received. As we started our phone conversation, the first topic Kelly wanted to discuss was the invoice he'd sent. Then he told me he had discussed the details of the new temporary orders with me and was clear. When I disagreed, he told me he was getting off the case! He had just accepted $2500 just days before! He's the stereotypical lawyer! No compassion, untrustworthy, and concerned about money above the best interests of his clients! Beware!!!

  • Kelly McCarty represented me in a legal matter a few months ago. He did a thorough job and solved my problem in a timely manner at a reasonable cost. I would recommend Mr. McCarty to my friends.
